TERMS & CONDITIONS OF ENTRY/SALE
DIY Backyard Event – Private Property Use Agreement
This document outlines the terms and conditions governing attendance at the private event (“the Event”) held on private residential property (“the Property”), organized by the homeowners and designated hosts (“the Organizers”).
By entering the Property and participating in the Event, all individuals (“Attendees”) expressly agree to be bound by the following terms and conditions.
1. ASSUMPTION OF RISK & VOLUNTARY PARTICIPATION
All Attendees acknowledge that participation in the Event is entirely voluntary and may involve exposure to certain inherent risks, including but not limited to:
Uneven ground, outdoor hazards, and temporary structures
Loud music, strobe lighting, or other environmental factors
Use or presence of alcohol or other legal substances
Large gatherings in non-commercial space
By attending, you assume full responsibility for any risks of personal injury, illness, property damage, or loss that may arise directly or indirectly from your presence at or participation in the Event.
2. WAIVER OF LIABILITY
To the fullest extent permitted by law, all Attendees hereby waive, release, and discharge the Organizers, homeowners, volunteers, performers, and any affiliates from any and all claims, liabilities, or causes of action arising from or in connection with:
Injury (whether physical, psychological, or otherwise)
Loss or damage to personal property
Death or any other harm suffered while on the premises or in transit to or from the Event
This waiver applies regardless of whether such injury or loss was caused by negligence, act of omission, or otherwise.
3. ALCOHOL & SUBSTANCE USE POLICY
Alcohol may be available or consumed during the Event. By attending, Attendees agree to the following:
Consumption is solely at the individual’s discretion and risk.
Persons under the age of 21 shall not consume alcohol under any circumstances.
No individual shall operate a vehicle while under the influence of alcohol or any substance after leaving the premises.
The Organizers are not responsible for any incidents, injuries, legal consequences, or damages that occur as a result of intoxication — either on the premises or after an individual departs the Event.
4. LEAVING THE PROPERTY
Once an Attendee leaves the Property, they do so at their own risk and volition. The Organizers assume no responsibilityfor any harm, misconduct, accidents, or injuries that occur off-premises, including but not limited to driving under the influence or any unlawful behavior.
5. PROPERTY DAMAGE
Any individual who causes damage to the Property, event equipment, or personal property belonging to others will be held fully liable for the cost of repair or replacement. The Organizers reserve the right to seek reimbursement for damages through any necessary legal or financial means.
6. RIGHT TO REFUSE ENTRY OR REMOVE GUESTS
The Organizers reserve the right to:
Refuse entry to any individual
Remove any person from the Event for disruptive, unsafe, unlawful, or disrespectful behavior
No refunds or compensation shall be provided in such cases.
7. PHOTO & VIDEO CONSENT
By attending the Event, Attendees consent to being photographed, filmed, or recorded. These materials may be used for promotional, archival, or social purposes without compensation or further approval.
8. LEGAL & JURISDICTION
This agreement is governed by the laws of the state in which the Property is located. Any disputes arising from attendance or participation in the Event shall be resolved exclusively within the appropriate courts of that jurisdiction.
9. ACKNOWLEDGEMENT OF TERMS
By entering the Property or participating in the Event, each Attendee affirms that they have read, understood, and agreed to the above terms and conditions in full.
